Definitions

"Customer" is the purchaser of the Products which has the status of consumer, meaning the natural and legal persons who make the purchase and act for purposes unrelated to any business or professional activity carried out;

"Site" is the set of web pages related to ILARIO CAFFE ';

"Prices" are the costs of the Products shown on the site;

"Delivery costs" are the shipping costs of the Products;

"Promotions" are the sales made by ILARIO CAFFE 'under special conditions for all or part of the Products and for limited periods of time;

"Cart" is the virtual container on the site of the Products selected by the Customer for the purchase;

"Conditions of sale" are the rules here below that govern the relationship between the customer and ILARIO CAFFE 'for the purchase of products

"Prompt delivery": items directly sent from our store within 48 hours at your home;

"Articles to order": items that require a longer delivery time because they must be ordered by our suppliers and their consequent shipment to our and then your home; for these orders you will receive notification of the receipt of your order;

"Delivery": delivery times are within a range of a minimum of 2 days to a maximum of 4 working days.

Object

The offer and sale on the website www.fioritostore.com integrate a distance contract governed by Articles 50 ss. of Legislative Decree 6 September 2005, n. 206 (Consumer Code), as well as the Legislative Decree 9 April 2003 n. 70 (c.d. Electronic Commerce Law). The purchase of products is intended for consumers.

These Terms of Sale govern the relationship between the Customer and ILARIO CAFFE 'for the purchase of Products on the Site.

The Customer is obliged to carefully read the Conditions of sale that ILARIO CAFFE 'makes available to him in order to allow him to reproduce and memorize the mentioned Conditions in compliance with the provisions of art. 12, co. 3 ° of Legislative Decree no. 70/2003.

Purchase mode

For the purchase of the Products the Customer must proceed with the registration by entering their personal details, following the instructions provided by the registration program, and must fill in and send to FIORITO STORE the purchase order form in electronic format available on the site, following the instructions contained in the Site. Purchase orders must be accurately completed in their entirety.

The Customer must enter the Product / s selected in the appropriate "Cart" and, after having viewed and accepted the contribution for delivery costs, can proceed with the purchase.

If the Customer needs to change the purchase order or to change some of the data contained in it, he / she must follow the appropriate modification procedure contained in the site. In particular, the Customer will have the right to change the quantity of the Products he intends to purchase, adding or deleting one or more Products from the Cart.

Once this operation has been completed, the Customer will display a screen containing the summary of the purchase order, including the delivery costs, with a request for further confirmation of the purchase procedure.

After viewing the summary, the customer must select the type of payment desired and "click" the "Go to checkout" button.

Payment

The prices of the Products are expressed in Euro and include VAT;

The prices of the Products are not inclusive of the Delivery Costs, the amount of which will be indicated to the Customer in the summary of the purchase order;

The price of the Product will be the one indicated on the site when ordering. Therefore, they will not be able to detect any increase or decrease in price, also in correlation with previous or subsequent promotional sales, the purchase order;

The Customer can choose between the two payment methods: by account and / or credit card on PayPal ™; by bank transfer.

Payment with PayPal ™, the Customer must provide the requested data that will be managed directly by PayPal ™ without having to re-enter the data of his credit card or prepaid card. PayPal ™ is a leading online payment company.

ILARIO CAFFE 'does not accept other unspecified forms of payment.

Shipments

The delivery of products will be made by courier and the timing will vary depending on the destination, the time when the order will be acquired and the availability of the product.

For the goods available ILARIO CAFFE 'will deliver to the Courier within 2 working days after receipt of the purchase order.

Except unforeseen delivery times on the national territory will be equal to 2 working days from delivery to the Courier. For places difficult to reach such as mountain resorts, smaller islands, extreme suburbs, delivery times will be 4 working days.

At the time of shipment you will receive an e-mail notification of shipment; you will also receive an e-mail directly from the courier who will inform you that you have taken charge of your package.

Our system will calculate your shipping costs based on some parameters dictated by the national courier and you can check the cost of your shipment at the end of filling your order by reading the summary under "Shipping". Please check carefully the order summary and the listed costs in order to avoid problems of various kind before sending your order and especially BEFORE PAYMENT.

Delivery times after shipment and possible delays do not depend on FIORITO STORE, which however undertakes to mediate and try to resolve any problems related to delivery with the courier. The Customer, with the acceptance of our terms of use, exempts ILARIO CAFFE 'from any liability in this regard. For shipping, the address provided during registration will be used, then carefully fill in the complete address field in its entirety.

After receiving e-mail notification of shipment, the courier will deliver on time established depending on the location to be served. We advise you to contact the courier directly if you are not at home to arrange a delivery at certain times, in order to avoid incurring additional costs.

Warranty for defective goods

Should you find damaged goods in your package, we invite you to send an e-mail to our address info@ilariocaffe.com within 24 hours from the receipt of the package, with attached photographic documentation regarding the damaged goods. The e-mail must also contain the reference number of the order and shipping. With the opening of the practice we will proceed to the reimbursement of the cost of the goods or, if you prefer, to a new shipment of the damaged goods all at our expense.

Right of withdrawal

1-Pursuant to and for the purposes of articles 64 and ss. D. Lgs. N.206 / 05 the customer can exercise the right of withdrawal, without any penalty and without specifying the reason.

The Customer must follow this simple procedure:

A) Send to ILARIO CAFFE 'within 7 days from receipt of the Product, by registered letter with acknowledgment of receipt, their wish to withdraw from the contract;

B) Provide, using a courier of your choice, the shipment of the product to ILARIO CAFFE '- San Emilio Scaglione, 112 - 80145 - NAPLES (NA) carefully packaged in the original packaging by including a copy of the registered letter sent.

B1) The communication can be sent, within the same term, also by telegram, e-mail and fax, provided it is confirmed by registered letter with acknowledgment of receipt within the following 48 hours.

B2) ILARIO CAFFE 'will proceed, by bank transfer, to the reimbursement related to the cost indicated in the purchase order and the first shipping costs, or to the one related to the Products for which the right of withdrawal has been exercised, within 30 working days following receipt of the Products.

B3) The exercise of the right of withdrawal will be ineffective if the returned product is not intact, or missing the original packaging, or for lack of integral elements of the product, or for damage to the product for reasons other than transport.

The customer accepts that in the presence of disputes, in the case of consumer user, the Court of residence or domicile of the consumer will be competent, if located in Italy. For any other controversy, the Court of Turin will be competent.

Privacy

To be able to purchase the Products on the Website it is necessary to provide the personal data requested in the appropriate form.

The data provided at registration are processed by ILARIO CAFFE 'for the purposes and with the methods described below and in any case in full compliance with Legislative Decree 196/2003 (Code regarding the processing of personal data) and its following edits.

The personal data provided are processed for the following purposes: a) obligations related to the stipulation and execution of the contract; b) statistical purposes and sending of advertising material, including through the use of electronic mail.

The processing of data for the purposes set out occurs both with automated and non-automated methods for the time necessary to achieve the purposes for which they were collected. Specific security measures are observed to prevent data loss, illicit or incorrect use and unauthorized access.

The provision of personal data by the user is optional. Any refusal to provide data for the purposes referred to in letter a) of paragraph 2 above makes it impossible to purchase the Products on the Website.

On the contrary, any refusal to provide data for the purposes referred to in letter b) does not determine any consequence on the possibility of purchasing the Products on the Website.

This contract, between ILARIO CAFFE 'and the Customer, is governed by Italian law.
